BPN-TRACK Privacy Policy, Terms of Use & Legal Disclaimer

BPN Solutions Pvt Ltd (“BPN-TRACK”, “Company”, “we”, “our”, or “us”) respects your privacy and is committed to protecting customer, vehicle, fleet, and transactional information collected through our website, mobile application, desktop panel, GPS devices, fuel monitoring sensors, and related telematics services. By purchasing, installing, accessing, or using any BPN-TRACK product or service, you expressly agree to the terms, policies, limitations, and disclaimers mentioned below.
1. Information We Collect
We may collect customer name, company name, phone number, email address, billing details, GST information, vehicle details, installation address, GPS location data, route history, ignition status, fuel level analytics, device IMEI/ID, SIM details, IP address, browser information, and communication records for service execution, support, analytics, and compliance purposes.
2. Consent for Vehicle Tracking & Fuel Data Monitoring
By using our GPS or fuel monitoring devices, customer confirms that they are the lawful owner, authorized operator, or duly permitted representative of the vehicle/equipment being monitored. Customer voluntarily authorizes BPN-TRACK to collect, process, store, and display movement data, fuel variation data, route logs, stoppage reports, and telematics analytics generated through installed hardware/software.
3. GPS Accuracy & Fuel Analytics Disclaimer
GPS location, route history, diesel theft alerts, fuel refill alerts, mileage reports, and all telematics analytics are generated through electronic sensors, GSM network availability, satellite signals, calibration inputs, and software algorithms. While BPN-TRACK uses advanced technology to provide high-level accuracy, the Company does not warrant that every reading, theft alert, refill alert, route point, or fuel percentage will be absolutely error-free under every terrain, weather, network, tank design, wiring, or user-handling condition.
All telematics reports provided by the system are indicative managerial tools intended to assist operational monitoring and decision making. Final managerial, disciplinary, legal, or financial actions taken by customer solely on the basis of software alerts shall remain customer’s independent responsibility.
4. Fuel Theft Detection Limitation
Fuel monitoring results depend upon proper tank calibration, physical sensor placement, electrical stability, fuel tank geometry, and periodic user verification. BPN-TRACK shall not be held legally liable for customer’s assumptions, labour disputes, driver allegations, staff salary deductions, or third-party accusations solely based on telematics-generated fuel movement notifications without physical verification by customer.
5. Installation & Third Party Fitting Liability Waiver
In many remote locations, installation may be carried out by customer’s local electrician, mechanic, fitter, garage staff, or technician under telephonic/video guidance from our team. In such cases, BPN-TRACK shall not be liable for any wiring disturbance, battery drain, short circuit, dashboard dismantling marks, local fitting negligence, labour charges, or accessory damage caused by third-party installers beyond our direct physical control.
6. SIM Network, Internet & Server Dependency
Real-time data transmission depends upon GSM network, SIM coverage, mobile internet availability, satellite visibility, and server uptime. Temporary delay, offline history sync, location buffering, delayed alerts, or interrupted live tracking due to telecom outage, low network zone, tunnel area, hilly terrain, jammer activity, weather interruption, or force majeure conditions shall not constitute service deficiency or legal breach on part of the Company.
7. Warranty Terms
Hardware supplied by BPN-TRACK generally carries limited warranty as specifically mentioned on invoice/order confirmation. Warranty covers only manufacturing defects under normal usage conditions and does not cover physical breakage, tampering, water damage due to misuse, fire accident, cut wiring, reverse voltage, unauthorized opening, deliberate sensor disturbance, or mishandling by customer/local mechanic.
8. Refund / Return / Activation Charges
Where refund assurance is offered, activation/configuration/server/SIM provisioning charges, courier charges, and technician visit expenses are non-refundable. Refund eligibility shall be determined only after technical inspection and management approval. Company reserves the sole right to accept, reject, or proportionately deduct refund claims based on hardware condition and service usage.
9. Data Storage & Confidentiality
Vehicle routes, fuel logs, user credentials, reports, and operational analytics may be stored on secured cloud/server infrastructure for service continuity, analytics, historical reporting, customer support, audit compliance, and product enhancement. While reasonable security measures are deployed, internet-based data systems are inherently vulnerable to technical breaches; therefore Company shall not be liable for indirect damages arising out of cyber incidents beyond commercially reasonable control.
10. Customer Responsibilities
Customer shall ensure proper electrical health of vehicle, timely communication of issues, non-tampering with hardware, safe SIM usage, availability of support labour during installation, and responsible use of reports. Customer must physically verify theft, refill, mileage, or behavioural anomalies before initiating punitive action against any employee/driver/operator.
11. Limitation of Liability
Under no circumstances shall BPN Solutions Pvt Ltd, its directors, employees, dealers, distributors, software team, or technicians be liable for indirect, consequential, incidental, punitive, labour-related, commercial, operational, reputational, or loss-of-profit damages arising from usage, interpretation, delayed alert, missed alert, inaccurate manual calibration, customer misuse, or third-party dependency of the system.
12. Indemnification
Customer agrees to indemnify, defend, and hold harmless BPN Solutions Pvt Ltd from all third-party claims, driver disputes, labour complaints, compensation demands, legal notices, departmental actions, and civil consequences arising due to customer’s independent managerial decisions, staff confrontations, or interpretations based on telematics data.
13. Jurisdiction
All disputes shall be subject exclusively to the jurisdiction of courts situated at Raipur, Chhattisgarh, India only.
14. Policy Updates
BPN-TRACK reserves the right to modify, update, amend, suspend, or revise this policy, software terms, warranty clauses, or service limitations at any time without prior individual notice. Continued use of products/services shall be deemed acceptance of revised terms.
